1) These General Conditions regulate and establish the terms and conditions governing the lease agreement between Pielle Sardinia S.r.l. and the customer. Pielle Sardinia S.r.l. reserves the right to modify these General Conditions at any time, which will automatically become effective once published on the website https://www.truck4rent.eu. The Customer has the right to view the General Rental Conditions at any time by accessing the link https://truck4event.eu/terms-conditions/.
2) The rental agreement is concluded only with the sending by the Customer of the order confirmation received by Pielle Sardinia S.r.l. and these General Rental Conditions, both signed for acceptance, as well as the advance payment of the amounts indicated in the order confirmation itself. After 24 hours from the date of receipt of the order confirmation without the Customer having done the above, Pielle Sardinia S.r.l. reserves the right to consider the order definitively lapsed without the need for any communication.
3) The order confirmation does not include anything not expressly indicated therein. Any additional services, such as, by way of example, assembly and / or disassembly and handling, and / or logistical aspects, such as, by way of example, deliveries at set times, on holidays, in limited traffic and / or pedestrian areas and / or in areas where special access, transit, parking and parking permits are required, not indicated by the customer when ordering, will be charged to the customer with the final balance and possibly deducted from the security deposit where paid. performed. The estimates of the furnishings and tensile structures carried out without an inspection are purely indicative.
4) The duration of the contract and the rental fee for the vehicles are those indicated in the order confirmation, without prejudice to the provisions of article 3 above.
5) The vehicles are rented clean and in a good state of maintenance except for normal deterioration due to the rental. The Customer is required to check his maintenance status at the time of delivery and immediately report it to Pielle Sardinia S.r.l. any flaw and defect, meaning, in the absence of disputes, accepted in full and without reservations by the Customer. It is strictly forbidden to glue stickers, scotch tape, labels, etc. On rented vehicles. In case of non-compliance, the cost of cleaning and / or any repurchase of the vehicles will be charged to the Customer at cost price. It is also expressly forbidden for the Customer to rent vehicles in turn, under penalty of termination of the rental contract pursuant to and for the purposes of art. 1456 cod. civ., without prejudice to the damages.
6) The payment of the amount due by the Customer, as indicated in the order confirmation, must be made within the deadline indicated therein. All prices indicated are 22% VAT excluded. Minimum rental amount: 500 €, VAT, transport excluded. In case of non-payment of the sums due by the Customer within the terms indicated in the order confirmation, Pielle Sardinia S.r.l. reserves the right to withdraw from the lease with immediate effect with consequent right to immediate return of the rented furniture and without prejudice to the right to payment of the amount due by the Customer until the end of the rental, in addition to any greater damage suffered.
7) Transport costs are charged to the customer unless otherwise indicated in the order confirmation. In the event that the collection of the material at the warehouses of Pielle Sardinia S.r.l. is carried out by the Customer, even through its own couriers, the use of open vans is expressly forbidden. In any case, the Customer will be required to prepare adequate and suitable packaging for the type of transport for the purpose of perfect conservation of the furnishings. In the event that special packaging is required, it will be necessary to request a quote from Pielle Sardinia S.r.l. . In any case Pielle Sardinia S.r.l. remains exempt from any responsibility for bad cleaning, damage or tampering caused during transport carried out by third-party couriers chosen by the Customer, who will be required to pay full compensation for the damage caused. Pielle Sardinia S.r.l. furthermore declines any responsibility for the cleaning of vehicles, even when it is the same to carry out the delivery, between the unloading area and the furniture positioning area, in all cases in which the same are subsequently taken over by external personnel to Pielle Sardinia Srl, on the occasion of fairs, events, demonstrations oni, stand fittings.
8) Unless otherwise indicated by the Customer on the order confirmation, the delivery of the vehicles by Pielle Sardinia S.r.l. means daytime, on the ground floor and with vehicle access; The Customer is responsible for all permits for circulation and transit, parking, loading / unloading, occupation of public land and anything else not specified in the order confirmation. If requested by the Customer, the installation of the rented furniture requires that the intervention area be free of people and things or logistical access impediments. The Customer undertakes to guarantee the necessary times, indicated in the contract, for the execution of the activities, to make the premises available, to provide the information necessary to reach the place of delivery / collection, taking care to advise on any impediments that may hinder the correct execution of the delivery / collection and / or installation operations. The Customer also undertakes to inform the staff present about the risks that may affect safety and to indicate the rules of conduct in the event of an emergency. If for reasons not dependent on Pielle Sardinia S.r.l. the assembly must be performed after the time set in the contract, an additional cost will be applied equal to the overtime hours carried out by the installation workers.
9) Where required, the Customer is required to pay, as a security deposit, the amount as indicated in the order confirmation. The return of the security deposit will be made after careful verification of the state of the vehicles which, for logistical reasons, could also take place in the days following the return of the goods. In the event of loss, theft, fire or deterioration of the vehicles, the Customer is obliged to notify Pielle Sardinia S.r.l. in writing. within 24 hours of the occurrence of the event by also providing you with a copy of the complaint submitted to the Judicial Authority and will be required to correspond to Pielle Sardinia S.r.l. the repurchase price of the same. Any possible loss and / or breakage and / or damage to the rented material will be charged to the Customer. As an alternative to the security deposit, at the request of the customer and where possible, Pielle Sardinia S.r.l. will extend to the Customer his own insurance policy at the cost indicated on the order confirmation for the entire rental period starting from the date of delivery of the furnishings and until their full return, provided that the amount thus determined is immediately paid by the Customer together with the obligations referred to in the previous article 2.
10) It should be noted that, from the date of delivery to the date of collection, the rented vehicles are considered entrusted under the care and custody of the Customer, who is therefore solely responsible for them. The Customer undertakes to keep and use the vehicles with the utmost diligence, in compliance with all the clauses contained herein and in accordance with current legislation, to use them in accordance with their nature, as well as the use for which these vehicles are typically intended. At the end of the rental contract, the Customer will be required to return the vehicles in the same state in which they were delivered, under penalty of compensation for damages. Pielle Sardinia S.r.l. disclaims any responsibility for the hypothesis in which the customer, in violation of the foregoing, uses the means in a manner that differs from their nature and / or the use for which they are typically intended. The Customer also undertakes to reimburse Pielle Sardinia Srl, upon presentation of an invoice, for all costs and expenses, including legal ones, which the same will be required to incur to obtain the fulfillment of the contractual obligations assumed by the Customer.
< br /> 11) Pielle Sardinia S.r.l. declines any responsibility deriving from damage to persons and / or things caused by the rented goods and the Customer undertakes to indemnify and hold Pielle Sardinia S.r.l. harmless. from any claim made for any reason by third parties for any damage suffered as a result of the use of the rented material.
12) The Customer acknowledges that the rental agreement and its vehicles are immediately booked for the scheduled delivery date and for the entire duration of the contract, thus resulting in the Rental Design S.r.l. the material impossibility of being able to dispose of it in favor of other customers. Unless otherwise agreed with Pielle Sardinia Srl, the Customer may withdraw, even partially, from the rental agreement, by written communication on the Customer's headed paper and countersigned by the same, exclusively in the following cases: no later than 48 hours after the conclusion of the contract in the event that the date of delivery of the furnishings it is expected beyond the following 15 days; no later than 24 hours after the conclusion of the contract in the event that the delivery date of the furnishings is expected to be between 15 and 7 days thereafter. In both cases the Customer will be required to pay a sum, as a penalty, equal to 50%, plus VAT. of the amount referred to in the order confirmation. For all other cases, the Customer's right of withdrawal is expressly excluded, who, apart from the hypotheses indicated above, will be required to pay in full the amount referred to in the order confirmation.
13) If the Customer is to be considered a Consumer pursuant to and for the purposes of Legislative Decree no. 206 of 06.09.2005, we inform the same that, in accordance with article 52 of the Consumer Code, he has a period of 14 days to withdraw from this Agreement, if concluded remotely or negotiated away from business premises, without having to provide no motivation and without having to incur costs other than those provided for by articles 56, second paragraph and 57 of the Consumer Code. Where the customer intends to make use of this option, the same, pursuant to art. 54 of the Consumer Code, must communicate, before the expiry of the period of 14 days from the conclusion of this Contract, an explicit declaration of their decision to withdraw from the Contract to be sent, in paper or electronic format, to Pielle Sardinia Srl, registered office: Pielle Sardinia Zona Ind. 15) The payment conditions indicated on the quote are to be considered valid. In the event of late payment, the Customer will be charged with default interest, from the first day of due date to that of the actual payment, pursuant to Legislative Decree 9/10/2002 n. 231.
16) Any dispute that may arise in relation to the execution and / or content and / or interpretation of these general conditions of contract, will be devolved to the exclusive jurisdiction of the Court of Turin, except in the case in which the Customer is to be considered a Consumer in accordance with the laws in force.
17) The rental agreement and these General Rental Conditions are governed by Italian law. For anything not expressly provided for in the rental contract and / or in these General Rental Conditions, the contractors expressly refer to the provisions of the law in force on the subject.
